DEP Cease and Desist and Violation Response in NYC

Receiving a DEP cease and desist or DEP notice from New York City’s Department of Environmental Protection means you need specialists who understand the system. Property owners in Brooklyn, Queens, Manhattan, and the Bronx are legally responsible for water and sewer lines running from their buildings to the city mains.

When the DEP identifies a leak, structural defect or illegal connection, it issues violation notices with strict timelines. Harris Water Main & Sewer Contractors is NYC’s oldest outdoor water main and sewer contractor. Our fourth-generation licensed master plumbers have resolved these situations for over 100 years. We handle permit coordination, excavation, repairs and final DEP sign-off with reliability built from a century of working relationships.

DEP-notices

Understanding DEP Notice Types

The DEP issues three primary violation categories, each with different timelines and consequences:

  • 3-day notice: A DEP 3-day notice is served when inspectors discover a leaking water main. You have three business days to hire a licensed outdoor plumber and complete repairs. Missing this deadline triggers a fine, water shut-off and escalation to a 10-day notice.
  • 10-day notice: The 10-day notice is followed by the DEP shutting off your water immediately. You have 10 business days to complete repairs before the DEP destroys the tap connection.
  • Cease and desist order: If you need to fix a DEP cease and desist order tied to a sewer line issue, we can address structural failures, illegal connections, pipes causing sinkholes and sewage backups while helping you work toward the notice deadline.

How We Resolve Violations

Our licensed master plumbers handle every step to resolve DEP violations in NYC. We inspect your property, confirm DEP findings and explain your options clearly.

Our specialized crew manages all DEP permit applications and street opening authorizations. We excavate controlled trenches and install code-compliant materials, such as Type K copper for water mains and approved pipe for sewer lines. With over a century of experience, we know what DEP inspectors require and how to coordinate inspections to meet deadlines.

Once approved, we backfill excavations, perform compaction testing and restore sidewalks. For sewer-related DEP cease and desist violations involving structural defects, we recommend full sewer line replacement over spot repairs.

Why Trust Our Team?

As the city’s longest-operating water main and sewer specialist, we offer:

We understand DEP business-day calculations and extension procedures. Our legacy of compliance reduces the risk of missing deadlines that could cost you thousands.

When inspecting a DEP cease and desist notice situation, we identify underlying conditions that could trigger future violations.

DEP violations create urgency, but we provide fixed estimates based on actual scope. You’ll never see inflated prices disguised as emergency service fees.
