A NYC DEP cease and desist violation is issued to a homeowner if the main sewer line has been determined as broken.  The most common reason leading to the cease and desist notice being issued is if the roadway suffers from a dip, crack or sinkhole, resulting in the DEP performing a camera inspection.  It is a good idea to get a second opinion by a licensed contractor if this happens however; the DEP is extremely accurate with their findings. It is also important to follow protocol upon excavation and confirm that the sewer line is broken while the ground is open.
